Money laundering and fraud conviction earns ANC councillor 5 years behind bars

- Nelson Mandela Bay ANC councillor Bongo Nombiba has been sentenced to 5 years behind bars for fraud and money laundering

- The councillor was convicted after he pocketed donations worth R20 000 meant for an NGO which rendered services to the elderly

On Thursday, Nelson Mandela Bay ANC councillor Bongo Nombiba was sentenced to five years behind bars by the Port Elizabeth Commercial Crimes Court. Nombiba was convicted on charges of fraud and money laundering in March.

Nombiba, a ward 20 councillor, was found to have pocketed donations worth R20 000 meant for an NGO which renders services to the elderly.

In handing down sentencing, Magistrate Johannes Claassen said that Nombiba showed a clear lack of remorse and abused his position of trust. Claassen said the offences were extremely serious, and as an office bearer, he had attempted to portray NGO staff as liars.

Briefly.co.za gathered that Nombiba’s lawyer, Luthando Ngqakayi, asked Claassen for a lesser sentence than jail time because he was a breadwinner for his family.

Ngqakayi said Nombiba had tried to serve the community in the best way he could and the fact that he was re-elected meant the community had faith in him.

State prosecutor Willhelm De Villiers said the offence amounted to greed not need. De Villiers said Nombiba had committed a despicable crime which was made worse by the fact that the community had trust in him.

Nombiba’s net salary was around R40 000 per month as a ward councillor.

The Thulamangwane Community Project is the NGO from which Nombiba defrauded money. In 2014 the NGO requested a R10 000 donation from the municipality through Nombiba.

Nombiba instructed the NGO to put the request in writing but to not mention the amount which they requested. During September 2014, a “Request for Donation” was prepared and signed by both the secretary as well as deputy chairperson.

During November 2014, an amount of R30 000 was paid into the bank account of the NGO. Nombiba conveyed to the NGO management that the Metro approved the donation and requested them to accompany him to the bank where he pocketed R20 000 of the money.

ANC Nelson Mandela Bay treasurer Mbulelo Gidani apologised to the residents of the city.
