The High Court in Pretoria has heard that Public Protector Busisiwe Mkhwebane did not reply to Pravin Gordhan's offer to respond to the findings against him in the Sars 'rogue unit' report.
Gordhan's lawyer, Wim Trengrove, claims that Mkhwebane has repeatedly ignored offers from those implicated in her investigations to respond.
According to Trengrove, this list includes not only Gordhan but also Shamila Batohi and Cyril Ramaphosa, among others.
This comes as Gordhan has filed an application to have the remedial action recommended against him by Mkhwebane suspended, Briefly.co.za has gathered. Gordhan says that the Public Protector is waging a "political war" against him and that her report against him is driven by "improper motives", according to The Citizen.
Additionally, Gordhan's lawyers argue that the formation of the so-called Sars 'rogue unit' was entirely lawful, despite the finding made by Mkhwebane. Trengrove says that the unit was established to combat crime and attempts to defraud the tax collector, rather than to pursue a personal or political agenda.
The Public Enterprises Minister's legal representatives have also rubbished the Public Protector's finding that Gordhan misled Parliament. They argue that there is no evidence to support Mkhwebane's conclusion.
As a result, they say there there is no reason for remedial action to be implemented against Gordhan within the next 30 days, as the Public Protector has recommended.
The matter is set to continue.
