Mkhwebane loses appeal over Estina report that 'failed South Africa'

Public Protector Busiswe Mkhwebane has lost her appeal attempt to overturn the judgment against her in the Estina saga. The Office of the Public Protector has confirmed the matter will be taken on at a higher level.

Public Protector Busisiwe Mkhwebane can add yet another court loss to her steadily growing collection.

Judge Ronel Tolmay dismissed her appeal in the controversial Estina debacle on Friday.

Handing down her ruling, Tolmay found that Mkhwebane had failed to prove another court would be able to come to a different outcome.

The Office of the Public Protector has commented on this latest loss, adamant it will be challenged:

"Public Protector Mkhwebane will soon be petitioning the Supreme Court of Appeal to challenge the decision of the High Court."

Tolmay stood firmly by her previous ruling on the matter, rejecting the bid and ordering costs to be paid by the advocate.

Mkhwebane herself commented on the loss, hinting that she had suspected the outcome ahead of the hearing:

“Not surprised, expected this outcome from Judge Tolmay.”

Briefly.co.za reported that Tolmay had found the Public Protector had 'failed the people of SA' with her investigation into the Gupta-linked scam meant to aid poor black farmers.
