A woman has taken the retail giant Woolworths to court after allegedly falling over a crate which was left unattended in an aisle. Ellen Matlhowana maintains that she suffered a fractured kneecap as well as soft tissue damage as a result of the fall.
Briefly.co.za has learned that Woolworths has denied that the crate had been left in the aisle and that there was no negligence on the part of the store, however, the store was prepared to pay 85% of the damages which Matlhowana could prove were caused from the fall.
Matlhowana, 49, was shopping on the 31st of March 2014 at Woolworths in San Ridge Square in Midrand.
While shopping she allegedly tripped over a crate which had been left in the aisle. She said that the store had been negligent and had posed a danger to its customers.
She claims that she is still experiencing discomfort to this day. Lawyers representing Woolworths had made an offer to settle with Matlhowana but she had rejected the deal according to iol.co.za.
The matter will now head to court where experts will testify over the evidence at hand and Matlhowana's injuries.
