The family of the accused has refuted the claims about rebranding their former eatery that is situated in Johannesburg. They have also denied the allegations that the accused still has shares in the family business.

The father of the accused, George, came out to make it clear by stating that the family did not have anything to do with Urban Eatery, which had come up a few months after Smokehouse went out of business. He went further to state that his son's remarks had affected the family businesses.

There are also some allegations that Adam has resigned from four of the family's businesses.

In 2018, during a family vacation in Greece, the accused recorded a short video in which he was bragging about being on holiday on a beach where there were no blacks in sight. What angered most people was the k-word that he used to refer to black people. Here is what he said in the video:

Let me give you a weather forecast here; blue skies, beautiful day, amazing sea and not one k****r in sight.
You cannot beat this. You cannot beat this.

When members of the Economic Freedom Fighters saw the video, they asked for help from the public to help in identifying the man. A few days later, the identity of the culprit was revealed.

Adam Catzavelos case

The racial remarks that Adam made while on vacation in Greece have culminated in him being summoned before the Randburg Magistrates Court for the ruling of the case. On 28th February 2020, through his lawyer, Adam pleaded guilty for committing crimen injuria. In the video, he used the k-word to celebrate the fact that there were no black people on the beach.

His lawyer went further to state that his client was under the influence of alcohol when he recorded the video and that he had shared it with close friends with no intention of making it public.

The lawyer went further to express his client's remarks, stating that Adam had suffered several instances of attacks. He narrated one case saying:

On one occasion while hiking at the Drakensberg Mountain earlier in the year, the accused and his party were attacked, and rocks were thrown at them and they had to run away. The perpetrators of that attack were black people.

The court ruling

The court gave Adam a suspended sentence of R50,000 or a two-year jail term. The court also issued another condition that should he commit another crimen injuria, he would have to either go to prison or pay a fine.

After delivering the judgment, the magistrate went further to state:

He pleaded guilty and this is a sign of remorse and that is mitigatory,

After the verdict was given, Adam stated that he was content with the ruling saying:

I’m very grateful that I had a very fair and reasonable judge,

The court ruling, however, did not relieve him from the settlement condition that he had reached with the South African Human Rights Commission in June 2019. According to the settlement, he is required to pay a fine of R150,000 in installments for two years. The ruling also required that Adam would spend 100 hours of community service at the Seth Mazibuko Foundation in Soweto, where he was nicknamed Mxolisi because he had owned his mistakes and apologised.
