He was recently embroiled in a court case surrounding his controversial article in the now-defunct Sunday Sun in which he wrote what was allegedly a homophobic opinion piece according to News24.

The Supreme Court of Appeal (SCA) had overturned a guilty verdict in the case in November. However, the court also threw out Qwelane's challenge to section 10 of the Promotion of Equality and Prevention of Unfair Discrimination Act (PEPUDA).

Parliament was given a year and a half to remedy the act and clear up any vagaries.
