Judge Overrules Decision to Reinstate Man Who Went to Work With Covid

Judge Edwin Tlhotlhalemaje of the South African Labour Court recently overturned a ruling made by the Commission for Conciliation, Mediation and Arbitration (CCMA) to have a man who travelled to work reinstated despite having known that he was positive for Covid-19.

The man, Sturrman Mogotsi, an assistant butcher at national meat supplier Eskort Limited, went against Covid-19 protocols when he tested positive for Covid-19 but proceeded to travel to work daily.

In footage shared by the company, Mogotsi could also be seen proceeding to hug another employee who has a heart condition after walking into work only a day after he was made aware of his positive Covid-19 test.

News24 reports that Mogotsi was sacked after the company learned of his Covid status but he took the matter to the CCMA who ruled in his favour stating that he should have been given a final warning and not sacked over the matter.

BusinessTech however reports that the company took the matter to the Labour Court where Judge Edwin Tlhotlhalemaje ruled against the CCMA, citing that Mogotsi had behaved recklessly and inconsiderately, and therefore carried the company's initial decision that Mogotsi be sacked.

In other news about reckless Covid-infected people, Briefly News also reported that a clip just over two minutes long of a passenger being removed from a FlySafair flight has gone viral on social media. The clip shows the unknown passenger becoming aggressive after being removed for not following Covid-19 protocols.

The passenger was not wearing a mask and became rowdy when attendants attempted to remove him. FlySafair stands by its decision to remove the passenger from their plane adding that it is the crew's responsibility, by law, to enforce these regulations.

Speaking to Briefly.co.za, FlySafair's Chief Marketing Officer Kirby Gordon said the reality is that the removal of the passenger is "the right thing to do".
