SOUTH AFRICA — The Madlanga Commission has resolved to pursue criminal charges against Major General Feroz Khan after he failed to appear before the inquiry on Monday, 28 September 2026, despite having been formally subpoenaed to testify.
Khan's evidence had been scheduled to begin at 09:30. The Commission had previously directed that he attend in person, with a limited exception only if an independent medical assessment confirmed he was unable to testify. No such clearance was granted, yet Khan did not appear.
Justice Madlanga condemns Khan's absence
Chair Justice Mbuyiseli Madlanga made clear that the non-appearance would not be overlooked. He described his view of Khan's conduct as "very dim," characterising it as a "flagrant disregard" of the subpoena. The Commission simultaneously rejected Khan's application for an extended postponement, signalling that it would not accommodate further delays.

The Commission's secretary has been directed to approach the relevant authorities and lay criminal charges against Khan for his failure to comply with the subpoena.
In camera application still pending
An outstanding application for Khan's evidence to be heard in camera, meaning outside public view, is expected to be considered on 6 October 2026. The Madlanga Commission's evidence leaders formally applied to shield parts of former South African Police Service Major-General Feroz Khan's testimony from the public, raising concerns about the safety of informants and the integrity of active criminal investigations. The application, submitted on 18 September 2026, requests that Commission chairperson Justice Mbuyiseli Madlanga permit Khan's evidence — specifically portions relating to material led on 7 and 9 July — to be heard in camera rather than in open proceedings.
Khan readmitted to hospital, misses Madlanga appearance
Previously, Briefly News reported that Major-General Feroz Khan reportedly been re-admitted to a Johannesburg hospital, days before his second scheduled appearance before the Madlanga Commission of Inquiry. The development comes roughly two months after Khan was shot and wounded in Houghton on 28 June 2026. The shooting took place shortly before he was due to face questioning at the Madlanga Commission. The Commission is investigating alleged corruption, criminality and political interference within South Africa's criminal justice system.
