CAPE TOWN — The Bellville Magistrates Court was expected to receive a case update on Monday regarding Aletta Rose, 63, who stands accused of murdering her 80-year-old sister, Constance Scholtz, in March this year.
According to Eyewitness News, Rose is alleged to have assaulted and killed Scholtz before decapitating her and severing her hands. She has yet to be formally tried, as questions surrounding her mental fitness to stand trial remain unresolved.
Psychiatric assessment still pending
The court referred Rose for psychiatric observation in June, following the collapse of her legal representation. Two Afrikaans-speaking Legal Aid attorneys had been assigned to her case, but Rose dismissed both. One of the attorneys informed the court that Rose was unable to provide instructions to assist her defence, and that she had indicated she would not cooperate given that she was already held at Pollsmoor Prison. The magistrate subsequently ordered the psychiatric referral.

As of her July court appearance, Rose had progressed from sixth to fifth on the waiting list to be seen by a district surgeon. No evaluation of her mental state has been completed, and her fitness to stand trial remains undetermined.
Case background
The alleged killing took place in March this year. According to the charge, Rose attacked Scholtz, who was her elder sister, and inflicted injuries that proved fatal. The subsequent dismemberment of the body formed the basis of the murder charge now before the court. The case has been adjourned pending the outcome of the psychiatric process. No further proceedings can advance until a formal assessment of Rose's mental state is submitted to the court.
