One of Bushiri's lawyers, Terrance Baloyi, is suing the South African Police Service for R15 million after he was arrested by the Hawks earlier this month and detained for around eight hours. According to reports, Baloyi's law firm, Ntsako Baloyi's Attorneys, sent out a letter of intent to sue on Thursday this week.
Mr Baloyi has also confirmed with a local news publication that he has given the police service 30 days to make the huge payment before further action is taken against them by him and his law firm.
Responding to Baloyi's decision to take legal action, the Hawks have said that the arrest was not unlawful. They also said that Baloyi and Alvin Khosa, a legal advisor, were arrested for corruption, defeating the ends of justice and intimidation in connection with the withdrawal statements by victims who had accused Bushiri of rape.
Meanwhile, locals have shared their thoughts on Baloyi's R15 million decision. Read a few of them below:
Mmote Nkwe said:
"Legally when you are arrested, and upon your release, it happens that the case is not enrolled in the court of law, this basically means that you were unlawfully arrested. As a citizen you have every right to make a lawsuit against the state, at the end of the day it is the court that should rule on whether your claim is valid or invalid."
Tresure KaKhombisa said:
"Lol 30 days, he is joking, that means Bushiri has run out of millions."
Tshepo Riba said:
"So Bushiri is gone and now he’s looking for a new source of income."
Bophelo Bo Boima said:
"Mara anything is possible, south African government is fruitless, dig them buddy."
In other Briefly.co.za news, the extradition hearing for Shepherd and Mary Bushiri has been postponed to 15 March. This follows reports that the couple's lawyer made an application for recusal of the magistrate in the case. Reports say that the self-proclaimed prophet's lawyer cited 'evident bias'.
According to the Bushiris' lawyers, the magistrate had changed. Their lawyers reportedly have information that the new magistrate is the same person who issued the warrant of arrest for the Bushiris.
The warrant of arrest is reportedly being challenged in the High Court in Malawi. The couple's lawyers believe the magistrate should not handle their clients' cases. According to News24, their lawyer said they had been ready to proceed with the matter in court until they realised that the magistrate had changed.
