DURBAN — The murder trial of Ferrel Govender and his brother Darren Govender, who stand accused of killing uMhlanga businessman Shailen Singh, has been postponed to Tuesday after a dispute over newly introduced WhatsApp evidence halted proceedings in the KwaZulu-Natal High Court in Durban.
According to News24, the adjournment followed an objection by defence counsel Mike Hellens SC, who challenged the State's attempt to table a bundle of WhatsApp messages exchanged between Singh and Ferrel Govender spanning roughly one month.
Hellens raised three specific concerns: that the bundle presented by the prosecution was incomplete, that the defence had been caught off guard by the late introduction of the material, and that no affidavit had been filed explaining how the messages were extracted from the cellphone.
State acknowledges late introduction of evidence
Senior State advocate Krishen Shah told the court that the WhatsApp conversation dated back to 30 October 2024 and had only come to light during preparations with a cellphone expert. Shah conceded that the timing of the disclosure was problematic and agreed that the defence needed sufficient time to review the contents before proceedings could continue.

Affair allegation at the centre of the case
The prosecution alleges that Ferrel Govender, the former head of private security firm Pro Secure, killed Singh over an alleged affair between Singh and Salona Ramrutton. Darren Govender faces charges alongside his brother in connection with the killing. Both legal teams are expected to consult ahead of Tuesday's sitting to determine a path forward. Should they fail to reach an agreement, the State will be required to file a formal application before the court in order to have the WhatsApp messages admitted as evidence.
