GAUTENG - AfriForum has officially filed a contempt of court application against the Economic Freedom Fighters (EFF) and the party's leader, Julius Malema.
AfriForum Chief Executive Officer (CEO) Kallie Kriel confirmed the filing, stating that the application was prompted by renewed calls from the EFF and Malema for illegal land occupation, in direct contravention of a court order that AfriForum obtained in 2017.
The filing was made before the High Court in Pretoria on Friday, 16 August 2026. It's not the first time that AfriForum has taken Malema to court.

AfriForum and Malema’s years of legal battle
The original court order, issued on 7 March 2017, prohibits the EFF and Malema from inciting, instigating, commanding, or procuring any person to trespass on or enter land without the permission of the owner or lawful occupant.
Since that order was granted, the EFF and Malema have made multiple attempts to have it set aside, all of which failed. Costs orders were awarded in AfriForum's favour in the resulting judgments.
The party and its leader escalated the matter to both the Supreme Court of Appeal and the Constitutional Court. The Constitutional Court dismissed their application in March 2023, and the Supreme Court of Appeal followed suit in June of the same year. A second bid to overturn the order at the Constitutional Court was also dismissed in September 2023.
What AfriForum is asking the court to do
In the latest application, AfriForum is requesting that both the EFF and Malema be found guilty of contempt of court. The organisation is asking that the EFF be fined R500,000 and that Malema be sentenced to 18 months' imprisonment, or that the court impose another appropriate sanction.
The application marks a significant escalation in the long-running legal dispute between AfriForum and the EFF over land occupation rhetoric. It places the matter squarely before the High Court for determination.
Malema says he's not intimidated by Afrikaners
Briefly News reported that Malema told supporters that he was not intimidated by young Afrikaner boys.
The EFF leader made the comments outside the East London Magistrate’s Court following his first day of pre-sentencing.
The Commander-in-Chief of the Red Berets also fired a slight jab at AfriForum, which laid the charges against him.
