GAUTENG — Former deputy national police commissioner Shadrack Sibiya will remain behind bars following a ruling by the Randburg Magistrate's Court on Tuesday, 20 October 2026, which dismissed his application for release.

Presiding Magistrate Hleziphi Mkhasibe concluded that releasing the 59-year-old former official would not serve the administration of justice. The ruling followed nearly three weeks of legal arguments regarding his custody status.

Grounds for bail refusal

The bench agreed with prosecutors that releasing Sibiya on bond would endanger key witnesses. The magistrate pointed out a distinct risk that he might approach and influence a vulnerable 16-year-old complainant. Additionally, the court highlighted findings that physical proof had been compromised by the accused.

Defence submissions regarding potential personal hardship during detention were rejected. The court observed that his commercial interests remain managed by relatives, his pension and medical coverage are secure, and correctional facilities are equipped to handle his ongoing medical requirements.

Before the decision, defence counsel Estelle Killian SC had offered a R20,000 surety bond, accompanied by conditions such as passport surrender and a strict non-contact order concerning all witnesses and complainants.

Pending criminal charges

Apprehended on 21 September 2026 by the Madlanga Commission's Recommendations Task Team, Sibiya confronts five counts. These comprise allegations of sexual abuse of an 18-year-old, a 16-year-old minor, and involvement in human trafficking for sexual exploitation. He maintains his innocence across all counts and remains in custody. Prosecutors indicated that the inquiry is nearing completion. The court rolled the matter over to 24 November 2026 for further processing, while Sibiya retains his legal presumption of innocence.
