Reality TV personality Mel Viljoen was seen breaking down in tears inside a Pretoria courtroom on 17 August as magistrate Nicca Setshogoe refused to grant bail to her husband, disbarred attorney Peet Viljoen.

The eNCA footage, filmed inside the courtroom in a handheld documentary style, showed the tense atmosphere as the ruling was delivered. Peet Viljoen faces a staggering number of charges, more than 400 in total, among them fraud and corruption.

Why the magistrate refused bail

According to eNCA news, magistrate Setshogoe was detailed in her reasoning, identifying three core grounds for her decision. She described Peet as a flight risk, noting that despite his family connections within the court's jurisdiction, the addresses offered by his wife's siblings were not sufficient to guarantee his stability. The court also pointed to the fact that he had recently been deported and had no assets in the country.

The magistrate further raised serious concerns about interference with and threats against state witnesses, ruling that no bail condition could adequately protect against this risk. Her third ground centred on public confidence in the justice system, with Setshogoe finding that granting bail would likely undermine trust in both the criminal justice system and the bail process itself. The magistrate stated in court:

"On a balance of probabilities, I find that the interest of justice will not be served by the release of the applicant."
