Connie Ferguson Seeks Eviction of Couple From R5.9m Ruimsig Property Over R549k Debt

Actress and businesswoman Connie Ferguson has taken legal action to remove a couple from a luxury Gauteng property, with court papers revealing a collapsed sale deal and mounting unpaid costs at the centre of the dispute.

Ferguson's company, Connie Ferguson Trading Enterprise, has filed an eviction application at the Johannesburg High Court against Vikar Maharaj, his wife Trisarnia Maharaj and any other occupants of the property located in Ruimsig, west of Johannesburg. The property is reportedly valued at R5.9 million.

According to the former CCV-TV presenter's founding affidavit, the two parties signed a sale agreement on 28 October 2025 for the purchase of the property at R6.5 million. The Maharajs took occupation on 1 December 2025 and were required to pay R65,000 per month in occupational rent until the property was transferred into their names, along with municipal utilities and related charges.

Ferguson alleges the couple subsequently fell behind on those payments. Her company issued a breach letter on 1 April 2026, giving the Maharajs a chance to remedy the situation. When no remedy followed, the company cancelled the sale agreement and instructed the couple to vacate the property on 6 May 2026.

Couple responds after Connie Ferguson takes legal action

The matter did not end there. A meeting took place on 14 May 2026, during which the Maharajs allegedly acknowledged the breach. They attributed their financial difficulties to alleged fraudulent conduct by their accountant, a claim Ferguson's company does not accept.

The couple reportedly asked to stay in the property until 31 July 2026 while they tried to settle the outstanding balance and secure bond approval for a new offer to purchase. Ferguson's company agreed and prepared a written undertaking to formalise the arrangement, but the Maharajs allegedly refused to sign it despite amendments made to accommodate them.

Court papers show that two payments were subsequently made: R100,000 on 19 May 2026 and R65,000 on 2 June 2026. A further R65,000 had reportedly been paid before they moved in.

By late August 2026, Ferguson says the total outstanding amount had grown to R549,302.43, covering unpaid occupational rent and municipal charges.

"The applicant is being deprived of the use, possession and beneficial enjoyment of the property and continues to incur financial prejudice. The applicant's intention is and remains to sell the property," she states in the affidavit.

Ferguson's company is seeking an eviction order, arguing it has no other adequate remedy available. It also notes that the Maharajs own two additional properties and would not be left without alternative accommodation.

Vikar Maharaj told Africa Daily that the couple had not yet been formally served with the court application.

"We have not been served with the papers, but we have spoken to our lawyers to speak to her attorneys to try to resolve the matter," he said.
