GAUTENG - Brown Mogotsi appeared briefly before the Johannesburg Magistrate's Court on 20 August 2026, where his legal team indicated that he would bring forward a fresh bail application based on new facts.

The North West businessman has had three bail applications rejected already, following his 15 May 2026 arrest. He was arrested in connection with a shooting in November 2025. The political fixer claimed that he survived an assassination attempt, but prosecutors allege that he fired 11 rounds into his own stationary, unoccupied vehicle in Vosloorus.

He faces charges of perjury, defeating or obstructing the ends of justice, unlawful possession of a firearm, unlawful possession of ammunition, and discharging a firearm in a public place.

Mogotsi to apply for bail once more

During the short court sitting, legal representatives for both the defence and the state confirmed the agreed postponement date.

Mogotsi's counsel noted a prior commitment on 25 August, but assured the court that a representative would attend to proceed with the bail application. The defence also confirmed that disclosure requests from the state had been substantially resolved, with a Section 87 application still outstanding on certain items. Both sides indicated a desire to finalise outstanding procedural matters so the case could be set down for trial.

Mogotsi has attempted to secure bail on three separate occasions but has had his bids rejected due to unverified residential addresses, a risk of evading trial, and State allegations that Mogotsi attempted to bribe the investigating officer and intimidate a witness.

During his other attempts to secure bail, the court found that his submission amounted to a reshuffling of previously presented evidence and not new facts.
