Western Cape High Court Orders Former MKP MP France Mfiki to Vacate State Property by 30 September

CAPE TOWN — The Western Cape High Court has issued an eviction order against former uMkhonto weSizwe Party MP France Bongani Mfiki, compelling him to vacate a unit at Laboria Park parliamentary village by 30 September 2026.

The Department of Public Works and Infrastructure confirmed it pursued litigation after Mfiki allegedly continued occupying the state-owned property without authorisation for more than two years following the conclusion of his parliamentary term on 7 August 2024. Should he not comply with the court order, the Sheriff of the Court is authorised to enforce the eviction on 1 October.

Macpherson defends department's legal action

Public Works Minister Dean Macpherson, who slammed former MPs for damaging property at the village, welcomed the ruling, stating that state accommodation is extended to MPs as a temporary privilege tied to their tenure, not a long-term personal entitlement. The department had issued Mfiki a formal notice to vacate on 11 September 2024, affording him the standard 30-day grace period that all outgoing MPs receive to arrange alternative housing.

When Mfiki did not comply, the department proceeded to court. Macpherson made clear that the department would not tolerate unlawful occupation of public assets and that legal proceedings were a necessary step to protect those resources.

2 Other former MKP MPs named in unlawful occupation

Beyond Mfiki's case, the department identified two additional former MKP MPs who had remained in state housing without legal basis. One of the individuals vacated the property voluntarily after being approached, while enforcement action is ongoing against the third. The department framed the crackdown as part of a broader effort to ensure that state-owned residential units are used appropriately and returned promptly once a member's parliamentary service ends.
