GAUTENG - The State applied for a warrant of arrest against suspended Crime Intelligence Deputy Head Major-General Feroz Khan after he failed to appear before the Kempton Park Magistrate's Court on Wednesday, 2 September 2026.

Khan, listed as accused number two in the precious stones case, did not attend the proceedings. His legal team submitted medical records to account for his absence, citing illness as the reason he could not appear.

The court accepted the medical incapacity, and the execution of the warrant was stayed pending Khan's recovery and his next scheduled court appearance. The Senior Crime Intelligence was due to appear alongside Tariq Downes and Gauteng Hawks head, Major-General Ebrahim Kadwa.

The case has been postponed to 27 November 2026.

A pattern of missed appearances

Khan's failure to appear is not an isolated incident. He had also been subpoenaed to testify before the Madlanga Commission of Inquiry, where he similarly did not show. His legal team cited a hospital readmission in Johannesburg as the reason for that absence. Khan's hospitalisation comes roughly two months after he was shot, an incident that drew significant public attention given his prominence in ongoing commission testimony.

Commission Chairperson Justice Mbuyiseli Madlanga did not accept a blanket medical postponement, directing Khan to undergo an independent medical evaluation by an agreed specialist before 8 September 2026 to verify whether he is genuinely unfit to testify. The commission ordered that he appear before it on 28 September 2026.

Khan attempts to halt disciplinary proceedings

Khan's legal difficulties extended further, as a Labour Court bid to halt internal SAPS disciplinary proceedings against him was struck off the roll on jurisdictional grounds. The court ruled it could not intervene in an incomplete internal process.

The disciplinary chairperson has invoked a provision that places Khan at risk of discharge, a matter he must now challenge through internal police structures.

General Khan's uncle speaks out about shooting

Briefly News reported that General Khan's uncle spoke out after the officer was rushed to the hospital in a critical condition.

Speaking outside the hospital, Preggy Padayachee said the family wanted justice and that those responsible must pay.

The shooting comes just days before Khan was due to testify before the Madlanga Commission of Inquiry.
