GAUTENG - The Madlanga Commission has confirmed that the subpoena compelling Major General Feroz Khan to testify remains in effect, despite reports that he was admitted to hospital two days before his scheduled appearance.

Commission spokesperson Jeremy Michaels addressed journalists on 31 August 2026, where he confirmed that Khan's legal team had been in contact with the commission, signalling a possible postponement application.

Michaels stated, however, that no such application had formally been lodged.

"He has been subpoenaed to appear before the commission. He is scheduled to appear before the commission tomorrow. His legal team has alerted us to the fact that they will be communicating with us, potentially seeking a postponement, but we have not received such a postponement application as matters stand," he said.

Khan's subpoena and court bid

The commission's position is that the subpoena stands unless a formal decision is taken to set it aside. Michaels noted that Khan had previously sought a court order to have his appearance postponed, adding further legal complexity to the already closely watched proceedings.

Khan's hospitalisation comes roughly two months after he was shot, an incident that drew significant public attention given his prominence in ongoing commission testimony.

At the time of the media briefing, the commission had not indicated how it intended to proceed should a postponement application be formally filed or should Khan's medical condition prevent his appearance. No official word had been given on alternative arrangements for his testimony.

Briefly News reported that WhatsApp messages presented at the Madlanga Commission showed a close relationship between General Khan and Advocate Andrea Johnson.

Evidence leader Advocate Mahlape Sello SC challenged Johnson on whether her relationship with Khan was deeper than she had disclosed in her earlier affidavit.

The Commission also heard how Khan and Johnson talked about having supper together on numerous occasions and even used terms of endearment with each other.
