GAUTENG – The uMkhonto weSizwe (MK) Party has suffered another loss in the country’s courts.

The party, led by Jacob Zuma, had its bid to prevent the Madlanga Commission of Inquiry from continuing struck off the roll.

The party filed an appeal in the Gauteng High Court in Pretoria, but it was struck off the roll as the court found that the matter was not urgent. The court also noted that the commission had already begun, so "the horse had already bolted".

Why does the party want to stop the commission?

Despite showing support for Lieutenant-General Nhlanhla Mkhwanazi and his allegations of political interference in the criminal justice system, the MK Party wants to stop the commission from looking into those claims.

Zuma and the party have argued that the commission was unconstitutional, saying it overstepped the powers of existing judicial bodies like the Judicial Service Commission (JSC) and the Magistrates Commission.

They’ve also objected to the fact that the commission is being led by Justice Mbuyiseli Madlanga, arguing that this was a conflict of interest, because the judiciary could not be both the accused and the investigator. Party members have been spotted outside the venue, protesting against its continuation.

MK Party challenges Cyril Ramaphosa’s decision

Zuma and the party are also challenging President Cyril Ramaphosa’s decision to place Police Minister Senzo Mchunu on special leave and appoint Professor Firoz Cachalia as the acting minister. They claim that this is unconstitutional and irrational.

Mchunu was placed on leave by the president in response to the allegations made by Mkhwanazi on 6 July 2025. The commission was also established by the president.

How did South Africans react?

Social media users were amused by the news, with many joking that the party’s lawyers were loving the constant legal battles.

Mthunzi Hlatshwako joked:

“😂Lawyers like this man. He is always running to court and giving them business. He is making his fair share in contributing to the South African economy. Very soon, he will be making another ill-advised trip to the South African courts, helping lawyers make a living🤞.”

Molemo Tholo stated:

“By the time the party dies, Dali will be a billionaire. He’s milking them dry.”

Mangaliso Ịhụnanya Eze Mangy said:

“Dali Mpofu has become an embarrassing legal expert. I'm sure even fresh legal graduates from TUT can argue and win a case against him now.”
