DJ Black Coffee’s legal battle with podcast host Nota Baloyi has reached another stage, with the Johannesburg High Court ordering Baloyi to submit his heads of argument in the ongoing contempt proceedings.
The order, granted by acting judge Sarita Liebenberg on 16 July, gives Baloyi 10 court days to file the required papers. The court also ordered him to pay the costs of the interlocutory application.
Black Coffee, whose real name is Nkosinathi Maphumulo, launched the contempt proceedings in January. The application centres on Baloyi’s alleged failure to comply fully with an earlier court judgment requiring him to retract certain statements and issue a public apology.
Why Black Coffee wants Nota Baloyi jailed
The legal dispute originated from an episode of the SA Hub podcast recorded in September 2025. During the episode, Baloyi allegedly made claims concerning Black Coffee’s financial affairs during his divorce from actress Enhle Mbali Mlotshwa.

The Johannesburg High Court later ruled in December 2025 that the statements were unlawful. The judgment ordered Baloyi to withdraw the remarks and publish an apology.
In his contempt application, Maphumulo argues that Baloyi has continued to disregard the authority of the court by refusing to fulfil the requirements of the order.
Black Coffee’s legal team maintains that the matter is no longer simply about the original statements. According to his case, court orders must be respected even when the person affected disagrees with the judgment.
What Nota Baloyi said about DJ Black Coffee's claims
Baloyi has opposed the contempt application and labelled it an abuse of the court process. He argues that he complied with the parts of the earlier order requiring him to stop referring to Maphumulo, saying he removed references to Black Coffee from his social media accounts in early December 2025.
However, Baloyi remains unwilling to publish the court-ordered apology.
He argues that doing so would force him to publicly describe his previous statements as false and defamatory, something he does not accept. Baloyi maintains that he stands by what he said and believes his comments were truthful and in the public interest.
The commentator has also argued that Black Coffee’s contempt application came too soon because he appealed the original judgment shortly after it was handed down.
In his court papers, Baloyi further alleges that Maphumulo contacted his mother during the legal dispute in an effort to put pressure on him. He is seeking R25,000 in damages over the distress he says the alleged contact caused.
What Happens Next?
The latest court order does not mean Baloyi has been found guilty of contempt or that he will be imprisoned. Instead, it clears a procedural step in Black Coffee’s application.
Baloyi must now submit his heads of argument within the period set by the court. The High Court will then hear the substantive contempt application and determine whether his refusal to issue the required apology amounts to contempt warranting a possible 60-day prison sentence.
