WESTERN CAPE - The Section 89 Impeachment Committee has confirmed it will mount a legal challenge against the Economic Freedom Fighters' urgent High Court application.

The EFF is seeking to overturn the removal of Advocate Thandazani Griffiths Madonsela SC as chief evidence leader in the Phala Phala parliamentary inquiry.

Committee members voted 18 to 9 on 1 September 2026 to rescind Madonsela's nomination. The decision followed concerns raised by President Cyril Ramaphosa regarding Madonsela's prior legal advice to the African National Congress on impeachment matters, which had not been disclosed at the time of his appointment.

EFF contests the decision

The EFF subsequently filed an urgent court application challenging the rescission, arguing that the decision was irrational and taken in bad faith. The matter is scheduled to be heard on 18 September 2026.

The party's legal action escalates an already fractious political environment surrounding the Section 89 process, which probes whether President Ramaphosa should face impeachment proceedings linked to the Phala Phala farm scandal.

President Ramaphosa himself launched a judicial review in the Western Cape High Court to have the November 2022 Section 89 Independent Panel report declared unlawful and set aside.

If the Western Cape High Court rules in Ramaphosa’s favour and sets aside the 2022 Section 89 Independent Panel report, the current impeachment inquiry against him would lose its legal foundation and likely grind to a halt.
