LIMPOPO — Attorney Charlotte Tibana and Tshwane Metropolitan Police Department (TMPD) officer Peter "Gagash" Nonyane appeared before the Polokwane Magistrates' Court on 26 August 2026, facing formal charges of fraud and theft linked to the estate of the late Albert Moetji.

The charges were read in open court on the same day, with the proceedings broadcast live by MDN News. According to the charge sheet, the two accused allegedly acted with common intent on or about 15 April 2026 in Polokwane, within the regional division of Limpopo. The State contends that Tibana and Nonyane falsely represented to Mohadi Andrica Moetji that they were authorised to conduct transactions on her late husband's estate bank account, and that R400,000 held in that account would be paid over to her as the sole heir.

What the state alleges happened

Prosecutors allege the pair transferred R400,000 from the estate account into bank accounts that were not linked to the estate's beneficiaries or creditors, contrary to what they had led the widow to believe. The charge sheet states that at the time of making those representations, the accused knew the money would not be paid to Mohadi Moetji and that they had no authority to transact on the account without her consent. The court was also informed that an alternative count of theft, arising from the same set of facts, had been included in the indictment.

Accused had over 1 million TikTok followers

Before their arrest, Tibana and Nonyane had built a significant social media presence, accumulating more than one million followers on TikTok, where they regularly posted content showcasing an affluent lifestyle. Investigators allege that the lifestyle was funded by money siphoned from deceased estates.The case has drawn considerable public attention in Limpopo, given the accused's profile and the nature of the allegations, which centre on the exploitation of a grieving widow and the assets of her late husband's estate.
