Brown Mogotsi Denied Bail for 4th Time, Court Rules He Is a Flight Risk

JOHANNESBURG — Self-proclaimed political fixer Brown Mogotsi has had his fourth bail application rejected by the Johannesburg Magistrate's Court, which ruled that he remains a flight risk and an untrustworthy applicant.

Mogotsi was arrested in May and has been in custody ever since. He faces charges of defeating the ends of justice and perjury, linked to allegations that he orchestrated his own attempted assassination in November last year.

Court rejects new addresses as grounds for bail

His latest application was built on what his legal team described as new facts, centred on two addresses: a family property in Mafikeng that has since been converted into a business, and a Johannesburg address selected, according to Mogotsi, to make compliance with any bail conditions more practical.

The court rejected the argument, finding that the new addresses do not constitute new facts sufficient to justify bail. Magistrate found that since his first application, Mogotsi has presented a total of five different addresses to the court — a pattern that investigative officers argued undermines any claim of stability or reliability.

Investigators flag pattern of address changes

Officers pointed out that the Johannesburg address was the same one Mogotsi had been using during his appearances at the Madlanga Commission, and that the Mafikeng property had also previously been placed before the court. Rather than demonstrating genuine rootedness, investigators argued that the continuous change of addresses reinforced the view that Mogotsi cannot be trusted to comply with bail conditions.

The court agreed, finding that his conduct across multiple applications painted a picture of an applicant who cannot be relied upon to surrender himself if released.

Mogotsi's legal team has not publicly indicated whether a fifth application is planned.

Previously, Briefly News reported that the Johannesburg Magistrate’s Court heard how Brown Mogotsi attempted to escape custody using a correctional service officer’s uniform.Prosecutors presented the escape plot as a central argument against granting Mogotsi’s latest bid for bail. Prosecutors explained that Mogotsi planned to dress as a prison official and slip out of the court cells undetected on 20 August 2026. The defence countered that the fourth application is founded on new facts and should be considered on its own merits.
